Coming Down With Something on Holiday Doesn’t Have to Mean the End of It ALL
The last thing that you want when you are on holiday is to suffer an injury or illness. You probably worked hard, saved hard and possibly waited years for this trip. But something has gone wrong and you suffer an injury or illness. You probably think your holiday is completely ruined and there is nothing you can do. So, what do you do when something goes wrong and you are away from home?
Well, when you booked your holiday you probably booked it through a tour operator who would have provided you with a package holiday (hotel, flights, transfers, car hire etc) all for one price. You were probably provided with a lot of fine print that, to be honest, you didn’t read all too closely. But that fine print agrees to a few important things:
1. The hotel complies with international food safety standards and general hygiene.
2. The hotel complies with local standards regarding safety.
If your hotel doesn’t comply with these regulations, you can take legal action against the tour operator you booked your trip with. You can do this under the Package Travel Regulations.
So how do you make sure you are eligible for reimbursement? The first thing you need to do is seek medical help as soon as you get sick or injured. You want to make sure that you get the best treatment possible and you want a firm diagnosis. Most hotels have a hotel doctor, but If you are not sure where to go the consulate in any country will be able to help you.
Once you’ve got someone taking care of you and you are ready give us a call. We will discuss your case and advise you on what you may be entitled to. All consultations are FREE and no obligation. All you need to do is keep copies of everything from your medical professional and everything you can about the trip you booked. Recalling what and where you ate if you fall ill is also useful in the case of sickness claims. We will then take care of the rest leaving you to focus on getting better, reassured that we will get the compensation that you deserve.
Even better, if you do not win, you do not pay. So, what do you have to lose?
Why People Get Sick
So just how could you end up sick on your holiday? Most people who find themselves sick on holiday find that it is from salmonella, which is an extremely dangerous form of food poisoning. This bacteria is found in dairy products as well as meat and fish products and can cause extreme gastro-intestinal problems. You may suffer from diarrhea, vomiting and fever for a short time or even more several days. If you get treatment quickly and start treating with antibiotics it usually resolves within a couple weeks. However, it can become extremely serious and may even cause permanent problems if you do not seek medical assistance.
Staphylococcus aureus, E. coli, campylobacter, shigella and clostridium botulinum are all types of bacteria that can affect food as well and can give you similar symptoms that you might suffer with salmonella, though potentially not as serious if left untreated.
It is important to note that not all illness that you come down with while on vacation will be actionable. You could fall sick simply from a virus in the air or even one that you had before you left on the trip. The change in diet may make you ill or even the increase of sun or dehydration. Still, if you fall sick while on holiday give us a call so we can help you figure out what your possible remedy may be. We may be able to help.
The most important thing is making sure that you contact us as soon as possible. If you wait too long the statute of limitations may be up, which can happen quickly. By contacting us quickly, you can make sure that you do not miss your chance to get the compensation you deserve.
What We Need to Pursue Your Case
So what do you need to do in order for us to help you with your case?
The most important thing is to give us a call as soon as possible and let us know what happened. We can do much of the work from there.
Next, get as much information as you can from anyone else that fell sick, even if they are not part of your party.
As soon as you start feeling sick write down everything that had to eat or drink and where you got it from. Food poisoning can take 24 hours or more to really get a hold so make sure you write down everything from the last couple days to be sure. Remember to include any snacks and even a small sip of something to drink.
If you see anything that seems to reflect poor hygiene of the staff at the hotel or food area make sure you take pictures immediately, even if you do not feel sick at the time. Photographic evidence is always an important tool and one that can help you immensely in your case. If photos are not possible then write it down and report it.
Any and all documentation from medical assistance you received including bills, a diagnosis, medical charts or anything else that you can get a copy of.
